2009 kom ett trevligt besked och det var att jailbreak blev accepterat, med andra ord kunde användaren själv välja om han eller hon ville jailbreaka sin iPhone, iPod touch eller iPad utan att företagen bakom enheterna kunde ta några rättsliga åtgärder. Innan dess var det osäkert om jailbreak var lagligt eller olagligt att genomföra, man skulle kunna säga att begreppet ”jailbreak” befann sig i en ”grå-zon”.

Men under 2009 kom som sagt beskedet från U.S. Copyright Office att det inte fanns något olagligt med jailbreak, med andra ord blev det lagligt att jailbreaka Apples ienheter. Men var tredje år sätter sig U.S. Copyright Office ner och ser över tidigare beslut, vilket betyder att under 2012 kommer en ny prövning genomföras då det kommer till just jailbreak av smartphones samt andra spelenheter.

EFF är de som tidigare drivit igenom beslutet kring jailbreak, och resultatet då blev att jailbreak blev lagligt. Nu är det som sagt dags igen att tala om vad VI anser om jailbreak, EFF har gått ut med information hur vi kan hjälpa till i detta arbete.

The Copyright Office needs to hear from people who depend on the ability to jailbreak to write, use, and/or tinker with independent software (from useful apps to essential security fixes) for smartphones, tablets, and game consoles. You can submit comments online at this link.

Here are some questions you might want to address in your comments:

  • Which jailbreaking exemption are you supporting—smartphones/tablets, video game consoles, or both?
  • What’s your background (i.e., are you a developer, hobbyist, academic, independent researcher, user, etc.)?
  • What device do you want to ensure you have the legal authority to jailbreak?
  • Please explain why you want to jailbreak this device. What limitations do you face if you aren’t able to jailbreak it? Is there software you couldn’t run, computing capabilities you wouldn’t have, cool things you couldn’t do, etc.?
  • If you’re a developer, did an online application store or console manufacturer reject your app or game? If so, what reasons did they give?
  • Is there anything else you want to tell the Copyright Office?

Concrete examples will help show the Copyright Office why they should renew and expand the exemptions for jailbreaking. Send your comments to the Copyright Office athttp://www.copyright.gov/1201/comment-forms/. Where the form says “Comment number(s) of proposed classes of works to which you are responding,” enter a “3” if you’re writing about game consoles or a “5” if you’re writing about smartphones or tablets.

Vi får verkligen hoppas att EFF driver detta med samma stryka som 2009, om inte kan det få tråkiga konsekvenser för alla som vill jailbreaka sin iPhone, iPod touch och iPad. Vi håller dig uppdaterad kring beslutet kring jailbreak.

    Om det blir olagligt så blir det ju bara det i usa eller? usa kan väl inte bestäm vilka lagar sverige ska ha?

    och vad händar om det blir olgaglit? kommer dev team och alla inga göra jailbreak eller får man bara böter om en lur är jailbreakad?

    Hur är det med rootning i android blir det okså olagligt?

    Dom borde lagt in att man va tvungen å skicka iväg ett mail med varför man skall få JB:a innan jailbreaket utförs. På så sätt så hade dom fått iväg minst 1 miljon mail på de första dagarna.

    Asså jag fattar inte varför dom vill göra det olagligt, det är fan din ägodel, du har betalat en fet summa för den, vad du gör med den är fan ditt ansvar, man kan tro att apple fortfarande vill äga enheterna som är sålda o begränsa vår frihet genom att bestämma HUR vi ska använda de? Så jävla patetiskt….

    Rent juridiskt sett så ska Apple inte kunna förbjuda dig att jailbreaka eftersom du äger iEnheten. Du är fri att göra vad du vill, men det är ingen garanti i världen som täcker det handlandet. Sen, om jag läst rätt, så nyttjar jailbreakarna bara enskilda filer i mjukvaran och klarar sig på så sätt undan att göra nåt olagligt. Ska man kunna förbjudas jailbreaka och dömas för det så måste tillverkaren ”äga” produkten man har och det skulle bli dyrt för Apple…=) Att dom äger rättigheterna på varumärket gör inte att dom automatiskt äger iEnheten. Har jag fel tror ni?

    Answer: Smartphones.

    What’s your background (i.e., are you a developer, hobbyist, academic, independent researcher, user, etc.)?
    Answer: User/academic/hobbyist.

    What device do you want to ensure you have the legal authority to jailbreak?
    Answer: Apple i-devices such as iPhone, iPad and similar.

    Please explain why you want to jailbreak this device. What limitations do you face if you aren’t able to jailbreak it? Is there software you couldn’t run, computing capabilities you wouldn’t have, cool things you couldn’t do, etc.?
    Answer: it gives me access to innovation and creativity provided by others than Apple, therefore stimulating general innovation in the world as well as providing me with a better unit. In practical terms it releases the use of technology that I have paid for, but for some reason are hindered to use. Specifically I like the possibility to tweak my iPhone so that I can make it look and feel the way I want; looks and feel. That is fun! It is also important that I can use software that makes my unit more effective to use. This will concern functions/ software not available for sale through App store. So it is NOT about having already available commercial software for free, it’s about managing your unit so it becomes more pleasant and effective to use. One concrete example: the screen of an iPhone (when you manage you applications) does not rotate to landscape mode. What this means is that when I put it in my car, horizontally, in order to use Navigation Software, I have to manage the iPhone ”sideways” leaning my head to the side in order to read the screen properly. This is just ONE example, and there are hundreds more for different situation. For this particular problem there is an excellent third party software available from the non-Apple community, that is not being sold through App store, that will just rotate the screen smoothly, nice and sweet, when I hold it horizontally.

    Answer: n/a.

    Is there anything else you want to tell the Copyright Office?
    Answer: keep an open mind and look to the greater good for the development of society rather than considering ”outdated” legal (or quasi legal) principles. I think it is important to recognize that a jailbreak requires a unit to be ”locked” in the first place. It is equally important to ask WHY a unit should be LOCKED, and I believe the argument against are powerful. When certain tools and applications becomes a part of our society and eventually a vital part of infrastructure and communication it should not be up to a few selected companies (private stakeholders) to control the flow of information, neither in what direction technology development should be focused. All limitations herewith are not for the good of the human race. Don’t get me wrong. People/companies must be paid for what they do, but I don’t think they should be allowed to lock you in. Imagine if you bought paint from a supplier in order to paint your house, and after that you were legally forced to continue to by from that supplier of paint for the rest of you life? Or until you by another house? Do the right thing now guys!
